Know More Coverage Requirements

Pursuant to Section 1, Rule II of the Department Order No. 40-03, series of 2003 Amending the Implementing Rules of Book V of the Labor Code of the Philippines, as amended, it is the policy of the State to promote the free and responsible exercise of the right to self-organization through the establishment of a simplified mechanism for the speedy registration of labor unions and workers associations.

Only legitimate or registered labor unions shall have the right to represent their members for collective bargaining and other purposes. Workers’ associations shall have the right to represent their members for purposes other than collective bargaining.

For CBA Registration:
Only legitimate or registered labor unions shall have the right to represent their members for collective bargaining and other purposes. Workers’ associations shall have the right to represent their members for purposes other than collective bargaining.

For UNION REGISTRATION:
All labor unions whose members are employed in commercial, industrial and agricultural enterprises, and employees of government-owned or controlled corporations without original charters established under the Corporation Code, including religious, charitable, medical or educational institutions whether operating for profit or not which exist in whole and in part for collective bargaining, and alien employees with valid working permits issued by DOLE

Applications for registration of independent labor unions, chartered locals, workers’ associations shall be filed with the Regional Office where the applicant principally operates.

CBA Registration:

  • Duly accomplished and notarized Application Form
  • Original and 2 duplicate signed copies of the CBA which must be certified under oath by the representative/s of the employer/s and labor union/s concerned
  • Statement that the CBA was posted in at least two (2) conspicuous places in establishment/s concerned for at least five (5) days before its ratification
  • Statement that the CBA was ratified by the majority of the employees in the bargaining unit of the employer/s concerned

Union Registration:
A. LOCAL CHAPTER(S)

  • Duly accomplished and notarized Application Form
  • Charter certificate issued by the federation or national union indicating the creation or establishment of the local/chapter
  • The names of the local/chapter’s officers, their addresses and principal office of the local chapter
  • The local/chapter’s constitution and by laws, provided that where the local / chapter’s constitution and by-laws is the same as that of the federation or national union, this fact shall be indicated accordingly.

B. INDEPENDENT LABOR UNION(S)

  • Duly accomplished and notarized Application Form
  • Minutes of Organizational Meeting and Attendance Sheet
  • List of Members
  • Financial Report if in existence for at least one (1) year
  • If less than 1 year, and has not collected any amount, a certification to this effect
  • Constitution and by-laws accompanied by the names and signatures of ratifying members.
  • Minutes of adoption or ratification of the constitution and by-laws, date/s when ratification was made and list of ratifying members.
  • Minutes of adoption or ratification is not required if it is done simultaneously with the organizational meeting and the same is reflected in the minutes of the organizational meeting including the date/s when ratification was made and list of ratifying members.
  • Statement that it is not reported as a chartered local or any federation.
  • List of members comprising at least 20% of the employees of the bargaining unit

C. FEDERATIONS AND NATIONAL UNIONS

  • statement indicating the name of the applicant labor union, its principal address, the name of its officers and their respective addresses
  • the minutes of the organizational meeting(s) and the list of employees who participated in the said meeting
  • annual financial reports if the applicant union has been in existence for one or more years, unless it has not collected any amount from the members, in which case a statement to this effect shall be included in the application
  • the applicant union’s constitution and by-laws, minutes of its adoption or ratification, and the list of the members who participated in it.
  • the resolution of affiliation of at least ten (10) legitimate labor organizations, whether independent unions or chartered locals, each of which must be a duly certified or recognized bargaining agent in the establishment where it seeks to operate
  • the name and addresses of the companies where the affiliates operate and the list of all the members in each company involved

For WORKERS’ ASSOCIATIONS

  • Duly accomplished and notarized Application Form
  • Name of the association officers and their addresses
  • Minutes of Organizational Meeting and Attendance Sheet
  • List of Members
  • Financial Report if in existence for at least one (1) year
  • If less than 1 year, and has not collected any amount, a certification to this effect.
  • Constitution and by-laws accompanied by the names and signatures of ratifying members
  • Minutes of adoption or ratification of the constitution and by-laws, date/s when ratification was made and list of ratifying members
  • Minutes of adoption or ratification is not required if it is done simultaneously with the organizational meeting and the same is reflected in the minutes of the organizational meeting including the date/s when ratification was made and list of ratifying members
